Terms and Conditions

1. Introduction

These Terms & Conditions govern the relationship between Leopard Trail Tours & Safaris ("we," "us," or "the facilitator") and the client ("you" or "the traveler"). By using our services, you acknowledge that you have read, understood, and agreed to these terms.

2. Role of the Tour Facilitator

We act as a facilitator, assisting with itinerary planning, accommodation bookings, transport arrangements, and activity scheduling in Namibia. We do not own or operate hotels, vehicles, or activity providers but work with third-party service providers.

3. Bookings, Contract & Payments

3.1 Booking Process

A confirmed booking requires a non-refundable deposit of 25% of the total cost.

Full payment must be received 65 days before the tour commencement.

Payments are accepted via bank transfer. 

A binding contract is established once Leopard Trail Tours and Safaris has received your booking request and deposit, and you have received written confirmation via email or invoice. 

By making the booking, the lead traveler confirms that they are authorized to accept these Terms and Conditions on behalf of all persons named in the booking. 

3.2 Pricing & Currency

All prices are quoted in Euro (EUR) unless otherwise stated.

3.3 Payment Failure

If payment is not received by the due date, we reserve the right to cancel the booking, and cancellation fees may apply.

4. Cancellations & Refunds

4.1 Client Cancellations

60 days before departure: 25% non-refundable deposit

59 to 30 days before departure: 50% Cancellation fees

Less than 29 days before departure: No refund

4.2 Provider Cancellations

If a third-party service provider cancels a service (e.g., a hotel or activity), we will assist in finding a suitable alternative, but we are not liable for refunds beyond what the provider offers.

4.3 Force Majeure

We are not responsible for cancellations due to natural disasters, extreme weather, pandemics, strikes, political instability, or other unforeseen circumstances beyond our control.

5. Travel Insurance

All travelers are strongly advised to obtain comprehensive travel insurance covering cancellations, medical emergencies, accidents, lost baggage, and delays.

We do not provide insurance and are not liable for any uninsured losses.

6. Client Responsibilities

6.1 Travel Documents & Health Requirements

Clients must ensure they have a valid passport, visas, vaccinations, and any necessary permits.

We are not responsible for issues arising from missing or incorrect documentation.

6.2 Conduct & Compliance

Travelers must comply with Namibian laws and regulations during their stay.

We are not liable for any fines, penalties, or legal issues resulting from a client’s actions.

7. Limitation of Liability

We are not responsible for delays, injuries, losses, or damages caused by third-party service providers.

Our liability is limited to the amount paid for our facilitation services and excludes indirect damages or losses.

8. Changes to Itinerary

We reserve the right to modify itineraries due to unforeseen circumstances such as weather conditions, provider cancellations, or safety concerns.

Any additional costs resulting from itinerary changes will be communicated to the client.

9. Privacy Policy

We collect client information solely for booking and travel arrangement purposes.

Personal data will not be shared with third parties except as required for travel arrangements.

10. Governing Law & Dispute Resolution

These Terms & Conditions are governed by the laws of Namibia.

Any disputes will be resolved through mediation or arbitration in Namibia, unless otherwise agreed.
